4.4 Legal, Regulatory, and Policy Framework of India

The legal and regulatory framework for the power sector in India comprises various legislation. Electricity laws or policies, their objectives, and the impacts are provided below.

Law or Policy Objective Impact

The Electricity Act, 1910 Infrastructure framework for electricity supply. Attracted private capital.

The Electricity Act, 1948 Mandated creation of state electricity boards. Ownership in the hands of state electricity boards.

Independent Power Producer Policy, 1991 Private investment in power generation. Indepent power producers were able to enter power generation.

The Electricity (Amendment) Act, 1998 Power transmission made a separate activity. Central transmission utility and state transmission utilities set up.

Mega Power Policy, 1995 Setting up of mega power plants. Mega power plants awarded.

The Regulatory Commission Act, 1998 Provision for setting up of the Central Electricity Regulatory Commission and State Electricity Regulatory Commission. Independent regulatory mechanism put in place.
